Ela-Mar Broken Hill Pty Ltd. (ABN 62 003 248 548) is a family-owned food distributor based in Broken Hill, supplying businesses and the public across Far West NSW. This policy explains how we collect, use, store and share personal information, and how you can access or correct it. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. Who we are

In this policy, “Ela-Mar”, “we”, “us” and “our” mean Ela-Mar, 5 Calcite Street, Broken Hill NSW 2880. You can reach us on (08) 8087 7153 or at griffin@elamar.com.au.

2. What we collect

  • From prospective customers: the only personal information we collect through this website is what you enter in our Contact Us form: your name, phone number, email address and your message.

  • From account holders: if you hold a trade account with us, we also keep your business name, ABN, delivery address, order history and payment terms.

  • Website usage data: the pages you visit, how long you stay, the device and browser you use and your approximate location, collected through cookies and similar technologies.

We don’t collect more than we need to respond to you and run the business.

3. How we collect it

We collect personal information when you complete our Contact Us form, apply for or use a trade account, place an order, call or email us or visit our store. We collect website usage data automatically when you browse this site.

4. Why we collect it, and how we use it

Details from the Contact Us form are used in house by the Ela-Mar team, only to contact you about your enquiry. We don’t use them for anything else, we don’t sell them and we don’t add you to a mailing list without asking you first.

For account holders, we use your information to set up and manage your account, process orders, arrange delivery, issue invoices and meet our legal and tax obligations.

We only use your information for the purpose we collected it, for a related purpose you would reasonably expect, or where the law requires or allows it.

5. Who we share it with

We don’t sell your personal information or share it for marketing. We share it only with the service providers we need to run the business, who handle it under their own privacy obligations:

  • Squarespace, which hosts this website and delivers Contact Us form submissions to our inbox

  • Google Analytics, which gives us anonymous website traffic data

  • Unleashed, our ordering system, and Xero, our accounting software (account holders only)

  • Our professional advisers, and government or regulatory bodies where the law requires it

Some of these providers store data on servers outside Australia, including in the United States. We take reasonable steps to make sure they protect your information.

6. Cookies and analytics

This site uses cookies to keep it working and to measure traffic through Google Analytics. This data is anonymous and doesn’t identify you personally. You can block or delete cookies in your browser settings, though parts of the site may not work as well. You can also opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

7. No Artificial intelligence (AI)

Ela-Mar doesn’t use AI to process, profile or make decisions about your personal information.

8. How we keep it safe

We store personal information on secured systems with password protection and access limited to the people who need it. We take reasonable steps to protect it from misuse, loss and unauthorised access. When we no longer need it and the law doesn’t require us to keep it, we delete or de-identify it. No online system is completely secure, so we can’t guarantee absolute security.

9. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, ask us to correct it or ask us to delete it by emailing griffin@elamar.com.au. We’ll respond within a reasonable time, usually within 30 days. We may need to confirm your identity first, and in limited cases the law allows us to refuse access, in which case we’ll tell you why.

10. Complaints

If you think we’ve mishandled your personal information, email griffin@elamar.com.au or call (08) 8087 7153 and we’ll investigate and reply in writing. If you’re not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) on 1300 363 992 or at oaic.gov.au.

11. Changes to this policy

We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated at the top.
